These terms govern your use of Kompozy. By creating an account or using the platform, you agree to them. They include specific obligations that apply when you connect Meta (Facebook and Instagram) accounts or other third-party platforms.
Kompozy is a product of BILT AI LLC, a Delaware limited liability company. In these Terms, "Kompozy," "we," "us," and "our" refer to BILT AI LLC operating under the Kompozy brand (DBA). By accessing or using Kompozy (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a legally binding contract. You must provide accurate, current information when creating an account, keep your credentials confidential, and notify us immediately of any unauthorized use. You are responsible for all activity under your account.
Kompozy is a content-creation, scheduling, and publishing platform that lets you generate text, images, audio, and video, and publish them to third-party platforms you connect, including Facebook, Instagram, YouTube, TikTok, X, LinkedIn, Pinterest, Threads, Bluesky, and email channels. We may add, modify, or remove features from time to time.
You agree not to use the Service to:
The Service connects to third-party platforms via their public APIs. Your use of any connected platform is subject to that platform's own terms and policies. We are not responsible for changes to third-party APIs, rate limits, content policies, or pricing that may disrupt the Service.
Meta Platforms (Facebook and Instagram). When you connect a Facebook or Instagram account through Kompozy, you additionally agree that:
You retain all rights to the source content you upload and to the generated output produced for your workspace ("Your Content"). You grant Kompozy a worldwide, non-exclusive, royalty-free license to host, store, transmit, process, transcode, and display Your Content solely as needed to operate, secure, and improve the Service and to publish on your behalf to platforms you connect. We will not use Your Content to train third-party AI models without your explicit opt-in.
You represent that you have all rights necessary to upload Your Content and that it does not infringe or violate third-party rights or applicable law. You are responsible for reviewing Your Content before publication and for any consequences of publishing it.
The Service uses third-party AI models to generate text, images, audio, and video. AI output may be inaccurate, biased, or duplicative of output produced for other users. You are solely responsible for reviewing, editing, and approving generated content before publishing it. You must comply with any disclosure or labeling obligations imposed by the platforms you publish to (including Meta's requirements for disclosing AI-generated content where applicable).
Subscription fees are billed in advance on a monthly or annual basis. Credits are consumed as content is generated and published. Unused subscription credits do not roll over. Pay-as-you-go credit packs do not expire but are non-refundable once purchased. Subscription cancellations take effect at the end of the current billing period. Taxes, where applicable, are added at checkout.
Full refund and cancellation terms — including the 7-day money-back guarantee, EU/UK 14-day statutory rights, outage credits, and chargeback policy — are documented separately at /refund-policy.
We strive for high uptime but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages (including Meta API outages), or force-majeure events may cause temporary disruptions. No refunds or credits are issued for outages shorter than 24 hours.
We may suspend or terminate your account, and revoke your platform connections, for violation of these Terms, violation of a connected platform's terms (including Meta's), non-payment, fraud, or conduct that harms other users or the integrity of the Service. You may cancel your account at any time from Settings → Billing. Upon termination, we will retain your data as described in the Privacy Policy and then permanently delete it.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT AI-GENERATED OUTPUT IS ACCURATE OR FIT FOR YOUR PURPOSES, OR THAT PUBLISHING THROUGH THIRD-PARTY APIS WILL BE TIMELY, RELIABLE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOMPOZY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE FEES YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD $100, WHICHEVER IS GREATER.
You agree to defend, indemnify, and hold harmless Kompozy and its affiliates from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from (a) Your Content, (b) your use or misuse of the Service, (c) your violation of these Terms, or (d) your violation of any third-party right or law, including the Meta Platform Terms.
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
We may update these Terms from time to time. Material changes will be announced in-product and/or by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
These Terms, together with the Privacy Policy and any order forms or in-product agreements, are the entire agreement between you and Kompozy regarding the Service. If any provision is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
Kompozy operates an A2P 10DLC SMS program ("Kompozy SMS Alerts") to communicate with users who affirmatively opt in. By providing your mobile number and accepting the SMS opt-in disclosure on a Kompozy signup, free-trial, or settings form, you agree to the terms in this section in addition to the rest of these Terms and our Privacy Policy.
You will not be sent any SMS message from Kompozy until you have provided express written consent on a Kompozy form that clearly identifies Kompozy as the sender, describes the message types, and discloses message-frequency and rate language. Consent to receive SMS is not a condition of purchaseof any Kompozy product or service. You may decline SMS and still use the Service.
The Kompozy SMS program is supported on major U.S. carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost Mobile, MetroPCS, Cricket, and others. Carriers are not liable for delayed or undelivered messages. Delivery of any particular message is subject to carrier conditions and is not guaranteed.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Full details on how we collect, store, and process mobile information are in the Privacy Policy, Section 13 (SMS / Text Messaging Communications).
